Unanimous Defense Verdict for Gerry Cushing
Gerry Cushing, with the assistance of Michael LaPinta, secured a unanimous defense verdict in Suffolk County on behalf of our client, an ED physician. The case involved a plaintiff who presented with complaints of a headache. His claim was predicated on the assertion that our client neglected to adequately consider and diagnose cerebral venous thrombosis (CVT), an exceptionally rare condition, as the root cause of his symptoms. Through compelling expert testimony, Gerry successfully demonstrated to the jury that the plaintiff did not possess any known risk factors for CVT. Furthermore, his presentation lacked many of the key signs and symptoms typically associated with CVT. Despite these factors, our client performed a comprehensive examination and procured CT imaging of the plaintiff’s brain, which revealed no abnormalities. Following this exhaustive evaluation, the plaintiff’s headache fully subsided, and he was subsequently discharged. In the end, the jury concurred that our client’s actions were entirely within the standard of care. They promptly returned a justified and well-deserved defense verdict.
