Gerard Cushing Obtains Defense Verdict in Nassau County in Record Time

In March 2019 Gerard Cushing obtained a unanimous jury defense verdict in a matter venued in Nassau County involving claims that a transforaminal lumbar interbody fusion was improperly performed on a 50-year-old resulting in permanent neurologic deficits and pain syndrome. Faced with plaintiff’s request for an award of $1,200,000 the jury agreed the surgical decisions made by the defendant were within judgment and standard of care, consistent with the testimony of both the defendant and expert defense neurosurgeon, and returned their verdict within one-half hour of receiving the case.
