The lawsuit involved allegations of negligence in the diagnosis and treatment of an esophageal anastomotic leak following a lengthy and complex surgery to remove a cancerous tumor from the 54-year-old patient’s esophagus, resulting in the need for a second surgical procedure. Our expert testimony proved that an anastomotic leak is a known and accepted postoperative complication. The patient was appropriately closely monitored postoperatively and that the surgical team timely discovered and repaired the leak when there was definitive evidence of a leak. The jury concluded the physicians acted in accordance with good and accepted medical practice, quickly returning a unanimous verdict for the defense.
