Health Care Litigation Wins Defense Verdict in Queens County Supreme Court
The skillfulness of Shaub Ahmuty health care litigation attorneys Henry Shaub and Mia-Liane Martinez was on display in the Queens County Supreme Court in their representation of a medical provider. The court rendered a defense verdict, holding that the involved medical providers’ care was appropriate and that the plaintiff’s allegations were unavailing.
The case involved an alleged failure to protect the patient’s airway leading to a cardiopulmonary arrest with resultant post-anoxic myoclonus. The defense successfully established that there was no indication for intubation prior the arrest. Henry and Mia further established that the patient’s myoclonus was caused by his underlying neurologic condition of autoimmune encephalopathy. Notably, plaintiff sought $62.5M in damages.
