Brian Casey Closes Out 2019 With Stipulation of Discontinuance

In December 2019 Brian Casey secured a stipulation of discontinuance on behalf of our insured physician following submission of a motion for summary judgment on his behalf.  The plaintiff could not overcome the affirmation of our expert in Orthopedic Surgery that the laminectomy and fusion performed at L3-4 and L4-5 were performed within standard of care, and the hardware failure which occurred was a known complication of the procedure.   Without opposition, the plaintiff discontinued the matter which was estimated to have a judgment exposure, if all claims of damages were accepted, in the range of $600,000 to $800,000.
