Decision Not to Administer tPA Appropriate Resulting In Order of Summary Judgment In Richmond County In Case With $10 Million Demand
In the face of a $10 million demand for settlement, in December of 2018 Lauren Daniels obtained an order of summary judgment on behalf of our hospital and physician clients. The plaintiff alleged that defendants failed to timely respond to stroke symptoms in a 16-year-old male, resulting in hemiplegia, with impaired ambulation and cognitive and behavioral deficits. We argued a neurology consult and CT were obtained within 30 minutes of arrival, therefore the evaluation was timely and comprehensively completed. Moreover, as the stroke symptoms first presented over five hours prior to admission, tPA could not be given based on the time of onset of symptoms and plaintiff’s age. After a full examination of the facts and multiple expert affirmations, Judge Thomas Aiotta, of the Supreme Court, Richmond County, wholly agreed with our position and dismissed the case as to our clients.
