Victory in First Department Appellate Division
Congratulations to Christopher Simone, Gerard Rath, and Payne Tatich for successfully defending our client’s favorable jury verdict in the First Department Appellate Division.
SACS obtained this victory in the First Department by successfully arguing that jury verdict was supported by the weight of the evidence, including witness testimony contradicting the plaintiff’s account of the accident and medical evidence showing plaintiff was not as injured as she claimed to be. Based on the evidence and the skilled arguments of our team, the First Department rejected plaintiff’s argument that the pain and suffering damage award was insufficient.
This decision reinforces the integrity of the original jury’s findings and highlights the exceptional legal work and strategic acumen demonstrated by Chris and Gerard in their briefing of the case, as well as Payne’s defense of the case at oral argument. Well done!
