Defense Verdict in Complex Medical Malpractice Case
Congratulations to partner Craig Bienstock on his latest trial win!
In this matter, the plaintiff’s attorney claimed that our client surgeon failed to timely treat the patient’s diverticulitis of the sigmoid colon complicated by a micro-perforation and infection, resulting in numerous injuries, including but not limited to peritonitis, sepsis and death.
During the trial, Craig was able to demonstrate that it was entirely appropriate for our client to attempt to treat the patient's condition via conservative management, as opposed to surgical intervention, and although the patient initially responded positively to the surgeon’s treatment plan, she ultimately developed a gross perforation five days later and was emergently brought to the operating room.
Craig was able to further demonstrate that the surgeon’s quick actions saved the patient’s life, and that her unfortunate death from cardiac arrest one month later was entirely unrelated to the client’s treatment.
