Another Summary Judgment Win for Jeffrey Schnaars

Congratulations to our partner Jeffrey Schnaars on another summary judgment win!

The case involved allegations of delayed diagnosis of extra-nodul T-Cell lymphoma of the larynx. 

The plaintiff claimed that Jeff’s client, an allergist, negligently misdiagnosed the patient's symptoms and failed to refer him to an appropriate specialist.

Plaintiff’s attorney alleged that the patient presented with symptoms such as sore throat, ear pain, fever, and a lump in the throat, and that our client failed to recognize the seriousness of these symptoms. Plaintiff’s attorney further claimed that our client's misdiagnosis and delayed referral led to a delayed diagnosis of the cancer, ultimately resulting in the patient's death.

Jeff argued that his client provided appropriate care for the patient's presenting symptoms, which were consistent with an upper respiratory infection or allergic reaction. The client timely referred the patient to an ENT specialist when the patient's symptoms persisted.

Furthermore, Jeff argued that the patient's subsequent medical care, including failed biopsy attempts, broke the chain of causation between our client's actions and the patient's ultimate outcome.

Plaintiff’s attorney asked for multiple adjournments but was unable to find an expert to oppose Jeff’s arguments.

The court agreed with Jeff’s arguments and dismissed the case.
