Complex Medical Malpractice Case Dismissed
We are proud to announce that Erin Stalzer recently secured a summary judgment dismissal on behalf of a physician assistant, an emergency medicine attending, a hospitalist, and an intensivist in a complex medical malpractice case.
The lawsuit stemmed from allegations of failure to promptly and properly detect, diagnose, and treat a 60-year-old patient’s hyponatremia. The plaintiff claimed that the defendants negligently overcorrected the condition, leading to irreversible Central Pontine Myelinolysis/Osmotic Demyelination Syndrome, and ultimately, the patient’s death.
The plaintiff’s pre-motion demand exceeded $5 million, but with the invaluable support of experts in emergency medicine, internal medicine, nephrology, and critical care, Erin successfully demonstrated that her clients provided timely and appropriate care, including the proper administration of normal saline in the Emergency Department and coordination with a nephrology specialist during the patient’s admission.
After reviewing all submissions, the Court agreed with our position, granting a dismissal with prejudice.
