Jeffrey Schnaars Secures Victory in Complex Medical Malpractice Case
Congratulations to our partner Jeffrey Schnaars, who recently secured a significant victory in a complex medical malpractice case involving allegations of negligence in the prevention and treatment of a patient's decubitus ulcers and ovarian cancer.
The plaintiff alleged that the healthcare provider failed to adequately treat the patient's pressure ulcers and failed to diagnose ovarian cancer. These alleged failures, the plaintiff claimed, led to serious complications and ultimately, the patient's death.
Jeff argued that the patient did not exhibit any signs or symptoms indicative of ovarian cancer during her hospitalizations. Additionally, the recommended endometrial biopsy, which the patient did not undergo, would not have diagnosed ovarian cancer. Jeff emphasized that the patient's advanced stage of cancer at the time of diagnosis was typical for this aggressive disease.
Jeff also demonstrated that the healthcare provider implemented appropriate wound care protocols, including regular assessments, debridement, and preventative measures. He highlighted the patient's pre-existing conditions and non-compliance with treatment recommendations, which contributed to the development and worsening of the ulcers.
The court agreed with Jeff’s arguments and granted his motion for summary judgment on both liability and causation. This decision affirms the appropriate standard of care provided by the healthcare provider.
