Defense Verdict for Marc Citrin and Joseph Alexander  after a Month Long Trial

After a month long trial, Marc Citrin and Joseph Alexander were able to win a defense verdict in Kings County for our clients, a hospitalist and a radiology group, in a wrongful death claim of a 41-year-old man. The case involved a patient with a recurrent episode of acute pancreatitis. It was claimed that he became septic due to an undiagnosed necrotic pancreas, resulting in his passing three days after his discharge. However, throughout the trial, Marc and Joseph were able to establish through expert testimony, effectively undermining the credibility of plaintiff’s experts on cross examination, and even utilizing non-party treaters to assist in the defense, that all appropriate tests were performed, labs were appreciated and the patient was improving and stable for discharge. In a unique stroke of trial strategy, they further established an alternate theory, that the patient's death was actually the result of an arrhythmia due to his significantly enlarged heart. The jury agreed, and entered a defense verdict on all 7 departure questions.
