Another Trial Win for Craig Bienstock
Congratulations to trial partner Craig Bienstock on his defense verdict in the Nassau County Supreme Court following a 2-week trial against a formidable adversary.
This was a complicated case wherein the plaintiff claimed that our client, a general practitioner who had treated the patient for several years, failed to appropriately formulate a differential diagnosis that included a potential heart problem. According to the plaintiff, our client failed to consider a cardiac etiology as the source of the patient’s complaints, and that as a result thereof, the patient passed away while undergoing treatment at a nonparty hospital approximately 1-month after last being seen by our client. During the trial, Craig successfully argued that the signs and symptoms the patient presented with to our client were related to another illness the patient had been diagnosed with approximately 5-months prior to his death, and that they were unrelated to an undiagnosed cardiomyopathy that eventually caused the patient to suffer a cardiac arrest.
