SACS Knocks Out 109 Cases with One Motion

SACS is pleased to announce that it achieved an important victory on behalf major regional healthcare system and affiliated hospitals, obtaining pre-answer dismissals of 109 cases. The motion addressed an intricate set of facts surrounding potential direct and vicarious liability claims arising from alleged criminal conduct by a doctor, who was not employed by the hospital, for alleged conduct that occurred for over 40 years at his private medical practice. The court agreed that the hospital did not owe the doctor’s private patients any duty of care and that it lacked notice of, and could not be vicariously liable for, his conduct.
