A Tough Fight for a Summary Judgment Victory

Congratulations to Colleen Buckley on a summary judgment win in Queens County. In a complicated case, involving an alleged failure to diagnose endocarditis, resulting in wrongful death and a substantial lost earnings claim, Ms. Buckley’s papers highlighted plaintiffs tenuous theories against our client, who was consulted for the purposes of a focused urology evaluation. The motion was supported by the affidavits of two experts who were able to establish that our client’s evaluation of the decedent was conducted in accordance with the standard of care and provided a strong causation defense. Relying on well established treatment guidelines, set fort by the experts, Colleen successfully argued that even if endocarditis had been diagnosed sooner the timeframe it issue would not have allowed for the treatment necessary to alter the outcome.  After careful consideration the court ruled in our favor.
